CLICK-WRAP: the Court of Justice considers it a valid communication
In the case 322/14, the Court of Justice considered the “click wrapping”, by which a purchaser agrees to general terms and conditions of sale on a website by clicking on a hyperlink which open a separate window, meets to the requirements of the Article 23 of the Brussels I Regulation. The Court ruled that the method of accepting the general terms and conditions of a contract for sale by the procedure of “click wrapping”, constitutes a communication by electronic means which provides a durable record of the agreement.
